By registering yourself, you represent that
You are at least 18 years old.
You are not disabled by any law from entering into a contract.
You have gone through the Terms and Conditions and agree to be bound
by them.
MEMBERSHIP
Mode
By registering your Profile through any of our domains
or by remittance of fees, you become a Member of Ismaili Date.
Membership is not automatic
Right of admission vests with Ismaili Date. You become
a Member upon due acceptance by Ismaili Date, of the Profile/Payment.
Length of Membership
You continue to be a Member till:
Ismaili Date discharges its obligations to you by
rendering of its Services to you, or
Termination of the Membership by either of us.
Privacy of Membership
Your Membership is for your personal use. It is not
to be assigned, transferred or licensed so as to be used by any
person.
Members are advised to make appropriate/thorough
enquiries before acting upon any advertisement. Our site does
not vouch or subscribe to claims and representations made by advertisers
regarding particulars of status, age, location or description.
Online Conduct
You are responsible for the content and information
[including profile and photograph] you post or transmit through
Ismaili Date' Services.
You will not post or transmit any content or information
(in whatever form they may be contained) that is defamatory, blasphemous,
abusive, obscene or sexually oriented, profane, intimidating,
illegal or in violation of the rights of any person, including
intellectual property rights; no such content or information shall
contain details or particulars of any of Ismaili Date' competitors,
including their contact details.
You will not use your Membership either online of
offline as a platform for any kind of promotional campaign, solicitation,
advertising or dealing in any products or services or transmit
any chain letters or junk mails.
Your membership will be automatically suspended if
you send an 'abusive, obscene or sexually oriented' message to
other Members.
Messages sent to opposite members should be for the
purpose of finding a life partner or a friend or someone to communicate
with in a civil manner.
We reserve the right to modify your profile, if
we find any prohibitive or objectionable content, or in case the
contact details are entered in fields apart from where relevant
like Phone, E-mail, Address fields etc. Ismaili Date may also
modify the profile for other reasons not mentioned herewith.
You will not post or transmit any content, information
or trademarks without the prior consent of the person holding
proprietary or licensed rights thereof. Ismaili Date will not
in any way be responsible or answerable in action brought by any
person arising out of your acts as described above.
Ismaili Date reserves the right but no obligation,
to edit, delete, eclipse or withhold display of such content or
information as it deems fit in the light of the rules prescribed
above.
REFUND OF FEE
Refunds will be given at the discretion of the Company
Management if you choose to terminate the membership for any reason.
If Ismaili Date terminates your membership, you will be entitled
to the prorated value of your remaining membership period.
Your membership in the Ismaili Date service is for
your sole, personal use. You may not authorize others to use your
membership, and you may not assign or otherwise transfer your
account to any other person or entity.
ROLE OF ISMAILI DATE
Online Conduct
Provision of Service: Ismaili Date will provide the
service[s] as may be opted and paid for by the Member. In addition,
you may make use of such of the other free services as may be
applicable to you.
Medium of Interchange of Information:
Besides the provision of the services, Ismaili Date
acts as a platform for all its Members to interchange information
that would promote their common social objectives.
It is to be distinctly understood that Ismaili Date
will only provide contact between and among members within its
service framework and not the direct contact details of such members.
Ismaili Date is not the agent of any Member and does
not partake in the interchange or the results thereof. Ismaili Date will be a disinterested person in the event of disputes between
or among the Members, though it may facilitate amicable resolution
of such disputes.
Right to form Consortium/Associates:
While providing Services, Ismaili Date may outsource
any part thereof to any competent person or organization, with
or without disclosing it to you. However, your Membership rights
and responsibilities continue as against Ismaili Date only and
not against such persons or organizations.
GENERAL PROVISIONS
Intellectual Property
Rights:
All rights [proprietary or otherwise, as the case
may be] including copy rights and trademarks in respect of the
services, content, information and data available on the non-public
domain of the Ismaili Date websites vest with Ismaili Date. You are not authorized to alter, modify, delete, copy, reproduce,
sell or transmit any part thereof in any manner whatsoever.
Confidentiality:
Ismaili Date will maintain confidential, all personal
information [other than that meant for posting or transmission]
furnished by Members. However, Ismaili Date may divulge such information
as may be required by law.
DISCLAIMERS AND LIMITATION OF LIABILITY
As
to the Services:
Ismaili Date provides the Services on an "as is"
basis and does not warrant in any way with respect to the merchantability,
suitability or adaptability of the services.
As to the infrastructure:
Ismaili Date promises to take all reasonable efforts
for the continued, secure and uninterrupted availability of the
Services. However, Ismaili Date disclaims liabilities for interruption
or non-availability of service, loss or damage of data due to
infrastructure, mechanical and systemic failure/breakdown or due
to events like rioting, war, Acts of God, Acts of State. In no
event shall the liability of Ismaili Date exceed the value of
the Service[s] paid up by the Member.
As to opinion, offers and advise:
All opinions, offers, advises, statements, predictions
made available through Ismaili Date's websites are those of the
respective authors and Ismaili Date shall not be deemed to subscribe
to or deny them in any manner.
As to extraneous contents:
Ismaili Date hereby alerts and warns its Members
of the possibility of unauthorized posting of contents by any
person including Members and unauthorized users and advises discretion
in access since such content, information or representation may
not be suitable to you including being offensive. Ismaili Date
will not in any way responsible for such contents, information
or representations.
Termination of Membership:
The Membership may be terminated by either of us
by serving a written notice on the other. Ismaili Date reserves
the right to terminate the Membership, to suspend a profile or
to disable access in respect of any Member in breach of any of
the terms. In such event, refunds will be given at the discretion
of the Company Management. These terms and conditions will survive
the Membership.
Suggestions, Complaints, Disputes:
Suggestions and complaints are to be first addressed
to Ismaili Date to its Customer Support Department at infoID@ismailidate.com.
The Membership is deemed to have been entered into at London, United
Kingdom and the laws of the United Kingdom will govern the Membership.
Disputes arising out of or in any way touching the Membership including
interpretation of any of the terms are to be referred to arbitration
under the Arbitration and Conciliation Act at London before a sole
Arbitrator.
